Please read these Terms of Service carefully before using Metriqs. They govern your use of our platform and form a binding agreement between you and Metriqs.
These Terms of Service form a binding agreement between you and Jack Watkin, trading as Metriqs, a sole trader registered with HMRC in England and Wales. Throughout these Terms, 'Metriqs', 'we', 'us', and 'our' refer to Jack Watkin trading as Metriqs. By accessing or using Metriqs, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the service.
Metriqs is a SaaS platform that connects to your marketing platforms — Google Analytics, Meta Ads, Google Ads, LinkedIn Ads, TikTok Ads, and Google Search Console — and automatically generates branded client reports. We provide the infrastructure and tooling; you retain ownership of your data and your clients' data at all times.
You must provide accurate information when creating an account and are responsible for maintaining the security of your password. Paid subscriptions renew automatically at the end of each billing period using your saved payment method. For annual plans, we will email a renewal reminder between 15 and 45 days before the renewal date. For monthly plans, your invoice serves as renewal notice. You may cancel at any time from Settings then Billing; cancellation takes effect at the end of your current billing period.
New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial. After the trial ends, you must subscribe to a paid plan to continue using the service. We reserve the right to modify or discontinue the free trial at any time. By starting your subscription and requesting immediate access to the service, you acknowledge that the service begins during any statutory cancellation period and, where applicable under the UK Consumer Contracts Regulations 2013, you agree to waive your 14-day cooling-off right once the service has begun.
You agree not to use Metriqs to: violate any laws or regulations; infringe third-party intellectual property; transmit malware or harmful code; attempt to gain unauthorised access to our systems; or resell or redistribute the service without our written permission.
We process your data as described in our Privacy Policy. You grant us the right to access data from connected platforms solely to provide the service. We do not sell, rent, or share your data with third parties for marketing purposes. You can disconnect any integration at any time from your account settings. Where you are located in the United Kingdom or European Economic Area, the processing of personal data in connection with this service is governed by our Privacy Policy, which constitutes our Data Processing Agreement for the purposes of UK GDPR and EU GDPR.
Metriqs and all associated materials are owned by us and protected by copyright, trademark, and other intellectual property laws. You retain all rights to your agency's content and your clients' data. The reports you generate belong to you.
To the maximum extent permitted by law, Metriqs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
We aim to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We are not liable for any losses arising from service downtime, data delays, or third-party platform outages (including Google, Meta, LinkedIn, TikTok, Stripe, or any connected provider).
We may update these Terms at any time. If we make material changes, we will notify you by email or in-app notification at least 14 days before the changes take effect. Your continued use of the service after that date constitutes acceptance of the updated Terms.
You may delete your account at any time from account settings. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your right to use the service ends immediately. We will retain your data for 30 days after termination before permanent deletion.
We do not offer refunds on monthly or annual subscription payments that have already been processed, except as follows: if you are not satisfied within the first 7 days of your first paid subscription, you may request a full refund by emailing hello@trymetriqs.com — no questions asked. After 7 days, no refunds are issued except where required by applicable law. If Metriqs experiences a service outage exceeding 24 consecutive hours due to our fault, affected customers may request a prorated credit by contacting hello@trymetriqs.com within 7 days of the outage. This refund policy does not affect any statutory rights you may have under applicable consumer protection law.
Metriqs is intended for business use by individuals aged 18 or over. By creating an account, you confirm that you are at least 18 years old and are using the service for professional or commercial purposes on behalf of yourself or an organization. We do not knowingly provide accounts to individuals under the age of 18.
Before initiating any formal legal proceedings, both parties agree to attempt resolution through good faith negotiation. Contact us at legal@trymetriqs.com with the details of your dispute. We will respond within 10 business days.
These Terms are governed by the laws of England and Wales. For customers located in the United Kingdom or European Economic Area, the courts of England and Wales have exclusive jurisdiction. For customers located in the United States, any dispute that cannot first be resolved through good-faith negotiation shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in English. Nothing in this clause prevents either party from seeking injunctive relief in a court of competent jurisdiction. If any provision of these Terms is found unenforceable, the remainder continues in full force.
You agree to indemnify and hold harmless Jack Watkin trading as Metriqs from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party right, including the data protection rights of your clients or their customers; or (d) any content or data you process through the service. This obligation survives termination of your account.
Where you connect client marketing accounts, you act as the data controller and Metriqs acts as your data processor for that client data. We process such data only to provide the service, in accordance with our Privacy Policy, which serves as our Data Processing Agreement for the purposes of UK GDPR and EU GDPR. A standalone Data Processing Agreement is available on request by contacting legal@trymetriqs.com.
